HS 2017 issues - DIBP update (NNF 2017/011)


 Further to NNF 2017/005 and as a result of our ongoing liaison, the Department of Immigration and Border Protection (DIBP) has provided the following update to the CBFCA for members' information. The latest HS 2017 issues update includes the following:

  • TCO transcription errors
  • TCO links
  • TCO numerical order
  • CP questions
  • Print availability

TCO transcription errors

Further changes have been made to Tariff Concession Orders arising from the HS/EITA changes to legislation. These changes have occurred after internal quality assurance and/or considering enquiries from industry. 

1. The following TCOs were subject of transcription errors. They have been revoked and reissued, with an operative date of 1 January 2017. They will be gazetted on 18 January 2017.

TC 1680124 has been revoked and reissued as TC 1705117.   

TC 1681231 has been revoked and reissued as TC 1680302.   

TC 1680268 has been revoked and reissued as TC 1702946.   

TC 1680273 has been revoked and reissued as TC 1702949.  

TC 1680124 has been revoked and reissued as TC 1705117.  

TC 1702802 has been revoked and reissued as TC 1705142.

2. Eight TCOs were incorrectly advertised in the DIBPN notices to be revoked. These were 8810540, 0706158, 1123300, 9807064, 1402365, 9607118, 0711701, 0616090. These have not been revoked and remain in place.  [As background, it was not possible to provide a single classification for these TCOs. Further the legislation does not allow for immediate revocation arising from a change in the customs tariff, so after consideration we did not proceed with revocations as advertised. However, given the advice relating to tariff classification, industry is advised that it is proposed that these eight TCOs will soon be advertised, via the alternative legislation mechanism of s269SD (1AA/1AB), with an intention to revoke them. Submissions objecting to this intention will be considered before a decision is taken]. 

3. TC 0605442 was revoked with effect 1 January but not subsequently reissued. It has since been reissued as TC 1705691, with an operative date of 1 January 2017.   

4. TC 1647352 has been revoked and reissued as TC 1705169, effective 1 January 2017.  [As background, this newly-gazetted TCO had not been included in preparation of the relevant DIBPN notices].  

Please note that, as a result of quality assurance and/or enquiries from industry, we are considering the status of a handful of TCOs where change took on 1 January 2017 through HS/EITA. We will provide an update to the CBFCA this week if any further changes are necessary.

Gazettal of TCOs:   Legislation requires that all changes to TCOs are gazetted as soon as practicable after decisions are made. In effect, the gazettal occurs after the decisions have been input to ICS. In a handful of cases, decisions that took effect on 1 January 2017 required a further revocation/reissue in the days following. In these cases, gazettals took place after the original TCO had been revoked/reissued a second time, meaning the gazettal notice was out of date by the time of publication. This caused some enquiries on the status of specific TCOs, however it is a requirement of the legislation that all decisions must be gazetted. Four gazettes were published last week, with a  further two gazettes to be published this week.

TCO links
The Department advised the CBFCA this morning that all the new TCO links contained in the online tariff have been rechecked with only two minor corrections required for:
•         4911.99.90
•         9406.90.00
For both, the TCO pages exist, the link just hasn’t been placed on the relevant online tariff page. This should be rectified by the time this communication is distributed.

TCO numerical order
As previously advised DIBP IT time frame for resolution remains 'by the end of January'.

CP questions
The ICS Business Support team advised that “there is an issue and it is that our CP Profiles that ‘trigger’ the various CP Questions have not all been updated to reflect the new Tariff Items. This means that in some instances CP Questions are not being asked where they should be and, if the question requires an Import Permit to be entered, there is no Permit Field in which to enter it (though LCBs could report Permit Numbers in the Goods Description field of the relevant FID Line if they wished).”

We came to an agreement that CBFCA can let members know to contact Cargo Systems Support (CSS at [email protected]) in the first instance and to request CSS to immediately forward the email on to COSS (aka ICS Business Support).  Include the words “HS2017 CP Query” in the subject line of the email.   Once received by ICS Business Support they will action and/or re-direct it as appropriate. Business Support is not aware of the extent of the issue at this time.

Print availability
There will be a reprint of just the affected sections NOT a full reprint. It is hoped to have the changes with the printer by early this week with generally a 4 - 5 day turnaround. Note reprints will be distributed directly from the printer with worst scenario being received week beginning 30th January.

NOTE: This is only reprints at this stage, initial issues have not been processed as yet.
