Revised Trading Terms and Conditions 2019


As part of its service to Business members, CBFCA regularly updates its template of Trading Terms and Conditions and associated documents. To give effect to recent legislative changes during that last 12 months, the 2019 updates which had been undertaken by the Association’s legal advisers Rigby Cooke Lawyers are now available to you on the CBFCA website. Your Association strongly recommends that you review the template and the revised documents for suitability in your business relationship with clients. While you may already have agreed Terms and Conditions, authority to act and other business related requirements with your client(s), it is suggested that you take the opportunity to again have these documents forwarded to your clients and agreed accordingly.

Rigby Cooke Lawyers have also included some brief additional guidance on the ACL provisions and their effect as this will have an impact on which provisions of the terms and conditions that can and cannot be used.

The templates are provided to enable you to personalise your business requirements in the document however, as always, these are provided as a guide.

While mindful as to the length and breadth of the Trading Terms and Conditions (and in some cases the desire of members to have these reproduced on the reverse of business related forms), legal advice is that the document should not be short formed or reproduced in a print size which is difficult to read in the normal course just to meet the reverse of form requirement.
