Webinar: Licensed customs broker liability as "owner" (TNF 2017/018)
As a CBFCA member, you would be aware of the uncertainty (and even more uncertainty) that has swirled around the term “Owner” and potential liabilities which may arise from the DIBP's interpretation of the term and for which the CBFCA has consistently over the year sought a more definitive policy.
Most directly for members, the CBFCA has been concerned as to the circumstances in which licensed customs brokers will be treated as the “owner” of goods.
Seeking clarification on the issue, the CBFCA has pressed the Department of immigration and Border Protection (DIBP) and the Australian Border Force (ABF) - and their predecessors - for some clarity on the issue. A draft Notice was circulated for review and commentary in April 2016. The CBFCA, in conjunction with its lawyer Andrew Hudson made a submission on that draft Notice and Andrew delivered commentary on the draft Notice and consequences in CBFCA events in person and online in April and May 2016.
The DIBP issued a revised draft of the Notice in March 2017 to which the CBFCA and Andrew provided commentary and which formed part of Andrew’s sessions at the CBFCA State Convention CPD sessions in April and May (and yet to come to Adelaide).
Given the importance of the recent Notice (DIBPN 2017/16) and its impact on industry, the CBFCA is pleased to provide a live webinar on the Notice and consequences which could arise from the DIBP's policy position, including what is not in the Notice and which, therefore, may create even more uncertainty for members.
